By using this Website, you agree to the Terms. We may vary these Terms at any time without notice and, if we do, we will provide the updated version on this Website.
If you do not agree to any of the Terms, you must leave this Website and not use our Online Services.
Medical Certificate Online requires that its agreements be made with persons who are qualified to contract. As a patient you must be over the age of eighteen (18) years. In the case of a patient being under the age of eighteen (18) years, a parent or guardian must accept this agreement and must be present at all consultations. We do not provide consultations to children under the age of 12 years of age.

Medical Certificate Online makes no warranties, whether expressed or implied, as to the content of any medical consultation conducted through our service. You and your doctor are solely responsible for all information and/or communication sent during a consultation or other communication. Your doctor will keep a record of their consultation with you.
Medical Certificate Online does not guarantee that an online Skype consultation is the appropriate course of treatment for your particular health care problem. You agree to contact your own doctor immediately should your condition change or your symptoms worsen. If you require urgent care, you should contact your local emergency services immediately.
The service offered is done so on an "as is" basis and used by the patient solely at his or her own risk. Medical Certificate Online may, among other things withdraw, suspend or discontinue any functionality or feature of its services.
All of the Treating Providers who deliver Services through Medical Certificate Online are independent professionals solely responsible for the services each provides to you.
Medical Certificate Online does not practice medicine or any other licensed profession, and does not interfere with the practice of medicine or any other licensed profession by Treating Providers, each of whom is responsible for his or her services and compliance with the requirements applicable to his or her profession and license.
Neither Medical Certificate Online nor any third parties who promote the Services or provide you with a link to the Service shall be liable for any professional advice you obtain from a Treating Provider via the Services.
When you register to obtain a product or service on this site, you accept the terms. Your use of any such product or service offered on the site is governed by these terms. Except as provided in the terms, Medical Certificate Online does not warrant that any product descriptions or content contained within the site is accurate, current, reliable, complete, or error-free.
As part of your registration you are required to provide us with certain personally identifiable information. It is your responsibility to update this information so our records are current, complete and accurate.
Medical Certificate Online reserves the right to cancel your registration without notice and at it's sole discretion.
- Modification of Medical Certificates or Any other Document issued to you by a Practice or Doctor serving you as part of this Service is Strictly Prohibited
By using this service you agree not to amend, modify, copy, transfer or share any and all documents issued to you as part of this Service with the intention of altering the documents issued to you for your use or by other persons. This includes Medical Certificates, Health Certificates or Statements, Carer or Attendance Certificates, Medical or specialist referrals or any other documents covering the routine medical procedures offered as part of this Service. Any attempt to modify a document will be construed as an intention to commit a fraud and will render the document null and void. In such circumstances, we reserve the right to commence legal action against you. Such actions will also constitute grounds for immediate cancellation of registration and ongoing service and site usage.
Documents issued to you by the practicing doctor or practice from this Service can only be copied or reproduced as to satisfy the person or organisation requesting its contents or the verification of its contents or in fulfilling the request of its intended use.
- Network & Data Security
Medical Certificate Online stores data online and as part of the terms you agree to your information being stored online in a secure location and accessed in this way. To facilitate your effective treatment we will supply your treating doctor with the information we have on record about you and provided to us by you.
- Recording Policy
Recording consultations by any means is strictly prohibited, unless expressly agreed to by all parties to that consultation. Unauthorised recording of consultations will be considered grounds for immediate cancellation of registration and ongoing service usage.
- Booking Fee Refund Policy
Medical Certificate Online charges patients a fee for its services. This fee is charged at the time a booking is made and will be refunded if the doctor cancels the appointment, or if there is a technological failure that prevents an effective consultation between patient and doctor.
Technological failure is assessed and logged by the doctor. The booking fee is generally not refundable if you, as a patient, cancel an appointment or fail to attend.
There is no refund under circumstances where a doctor has provided a medical assessment and determined that the issue of a medical certificate is not appropriate or necessary for whatever reason. The doctor’s judgment will stand as the final decision on the matter and is based on the patient’s symptoms and the doctor’s assessment. Where the doctor deems that issuing a medical certificate may be inappropriate, and not in the best interests of the patient’s health, a medical certificate will not be issued. Medical Certificates will also not be issued if the doctor believes there is a deliberate intent by the patient to commit a fraud in seeking the Medical Certificate. However, the doctor will issue a statement to the patient setting out relevant recommendations for either improving health or a request that the patient seek further medical treatment. This may include seeking a second opinion via a face-to-face appointment with a local doctor.
In some circumstances for example, a physical examination, blood tests, or diagnostic imaging may be required. These elements cannot be delivered via an e-health appointment. If the doctor determines that any or all of these are required, and in the patient’s best interest, the doctor will direct you to make an appointment for an in practice consultation with your local general practitioner.
As part of this service, doctors will not issue medical prescriptions to patients. Doctors will only make recommendations regarding readily available, over the counter remedies available from your local pharmacist or chemist. If you require medical scripts, we recommend that patients visit their local GP. Where a patient is currently being treated by a local GP with prescription medicines, we would recommend that a patient see their local GP or treating doctor for the issue of further prescription based medications.
- Intellectual Property Information
The site and the content within the site are the property of Medical Certificate Online or its suppliers and are protected by laws relating to intellectual property, including copyright laws, and international treaty provisions. The compilation, organization and display of the content as well as all software and inventions used on and in connection with the site are the exclusive property of Medical Certificate Online. Medical Certificate Online reserves all rights in the site and its content not specifically granted in any agreements with Medical Certificate Online or in the terms.
- Informed Consent
Telehealth is the delivery of health care services using interactive audio and video technology, where the patient and the health care professional are not in the same physical location.
During your telehealth consultation with a Treating Provider, details of your medical or health history and personal health information may be discussed with you through the use of interactive video, audio and other telecommunications technology.
Depending on your medical or health history and/or specific complaint, you may be asked to provide information through biometric devices such as digital thermometers or blood pressure cuffs. You may also be asked for proof of identity with a driver’s license or other legal document. We reserve the right to deny Service provision where the doctor believes proof of identity has not been satisfactorily established.
The telehealth Services you receive from Treating Providers are not intended to replace a primary care physician relationship or be your permanent or primary care medical relationship. You should seek emergency help or follow-up care when recommended by a Treating Provider or when otherwise needed, and continue to consult with your primary care physician and other healthcare professionals as recommended.
We may make arrangements for follow up care either through Medical Certificate Online, a health systems partner or other healthcare providers. If the transmission fails during your telehealth consultation with a Treating Provider, the Treating Provider will make an attempt to reach you again via your Skype address or finally attempt to contact you by telephone.
If you are not contacted by the Treating Provider, then a member of our customer support team will contact you to help you get reconnected. You will have direct access to our customer support services to follow up on following your appointment. We hope that among the benefits of our Services are improved access to healthcare professionals and convenience. However, as with any medical or health service, there are potential risks associated with the use of telehealth. These risks include, but may not be limited to:
- In rare cases, information transmitted may not be sufficient (e.g. poor resolution of images) to allow for appropriate medical or health care decision making by the Treating Provider;
- Delays in evaluation or treatment could occur due to failures of the electronic equipment;
- In rare cases, a lack of access to all of your medical records may result in adverse drug interactions or allergic reactions or other judgment errors;
Although the electronic systems we use will incorporate network and software security protocols to protect the privacy and security of health information, in rare instances, security protocols could fail, causing a breach of privacy of personal health.
- You understand that you may expect some anticipated benefits from the use of telehealth in your care, but that no results can be guaranteed or assured.
- You understand that the laws that protect the privacy and security of health information apply to telehealth, and have received and read Medical Certificate Online’s Notice of Privacy Practices, which describes these protections in more detail.
- You understand that Medical Certificate Online is not covered under Medicare Australia at this time and there is no bulk billing option offered as part of this service at this time.
- Your Treating Provider may determine that the Services are not appropriate for some or all of your treatment needs, and accordingly may elect not to provide telehealth services to you through the Site or issue a medical certificate to you based on their sole discretion of your stated health condition. These decisions are in your Treating Provider’s sole discretion.
- Release and Indemnity
In consideration of Medical Certificate Online (which expression shall be taken to include Medical Certificate Online's servants, agents, officers and directors, successors or assignees) agreeing to permit me use of the site and it’s ancillary services:
I release Medical Certificate Online from all claims which I have, now or later against Medical Certificate Online whether for: personal injury (including death and disability) or otherwise, and whether occasioned by:
- breach of contract,
- breach of statutory duty or
suffered as a result of or in connection with my using the site and ancillary services.
I indemnify and will at all times in the future indemnify Medical Certificate Online against all proceedings, actions, claims or demands made by any person for: personal injury (including death and disability) or otherwise, and whether occasioned by:

suffered as a result of or in connection with my using the site and ancillary services.
As part of providing you the Services, we may need to provide you with certain communications, such as appointment reminders, service announcements, relevant marketing messages, new complimentary service announcements and administrative messages. These communications are considered part of the Services and your Account. Secure electronic messaging is always preferred to insecure email, but under certain circumstances, insecure email communication containing personal health information may take place between you and Medical Certificate Online.
Medical Certificate Online cannot ensure the security or confidentiality of messages sent by email.
- Marketing, Sales & Customer Service
By registering with the site for the service you agree to receive ongoing marketing communications, sales materials and communications, customer service and support contact relating to the site and its services; including but not limited to new and complimentary services. - User Accounts
When you register on the Site, you are required to create an account (“Account”) by entering your name, email address, password, Skype name and certain other information collected by Medical Certificate Online (collectively “Account Information”).
To create an Account, you must be of legal age to form a binding contract. If you are not of legal age to form a binding contract, you may not register to use our Services. You agree that the Account Information that you provide to us at all times, including during registration and in any information you upload to the Site will be true, accurate, current, and complete. You may not transfer or share your Account password with anyone, or create more than one Account (with the exception of subaccounts established for children of whom you are the parent or legal guardian). You are responsible for maintaining the confidentiality of your Account password and for all activities that occur under your Account. Medical Certificate Online reserves the right to take any and all action, as it deems necessary or reasonable, regarding the security of the Site and your Account Information. In no event and under no circumstances shall Medical Certificate Online be held liable to you for any liabilities or damages resulting from or arising out of your use of the Site, your use of the Account Information or your release of the Account Information to a third party. You may not use anyone else’s account at any time. We also reserve the right to request proof of identity at the commencement of each appointment. If we are not satisfied by this proof we may deny offering services to you through the Site.

You understand and agree that for Services provided on an appointment basis, you will be responsible for a missed appointment fee equal to the fees you would have paid for the scheduled services if you do not cancel a scheduled appointment at least 24 hours in advance.
The Site and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by Medical Certificate Online, its licensors or other providers of such material and are protected by Australian and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
Certain of the names, logos, and other materials displayed on the Site or in the Services may constitute trademarks, trade names, service marks or logos (“Marks“) of Medical Certificate Online or other entities. You are not authorized to use any such Marks without the express written permission of Medical Certificate Online. Ownership of all such Marks and the goodwill associated therewith remains with us or those other entities.
You may deactivate your Account and end your registration at any time, for any reason by sending an email to firstname.lastname@example.org. Medical Certificate Online may suspend or terminate your use of the Site, your Account and/or registration for any reason at any time. Subject to applicable law, Medical Certificate Online reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Site pursuant to its internal record retention and/or content destruction policies. After such termination, Medical Certificate Online will have no further obligation to provide the Services, except to the extent we are obligated to provide you access to your health records or Treating Providers are required to provide you with continuing care under their applicable legal, ethical and professional obligations to you.
- Right to modify
YOU EXPRESSLY AGREE THAT USE OF THE SITE OR SERVICES IS AT YOUR SOLE RISK. BOTH THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. You acknowledge and agree that Medical Certificate Online does not provide medical advice, diagnosis, or treatment, and is strictly a technology platform and infrastructure for connecting patients with independent third party Treating Providers, including physicians and other Treating Providers in the Medical Certificate Online network. You acknowledge and agree that the Treating Providers using the Site are solely responsible for and will have complete authority, responsibility, supervision, and control over the provision of all medical services, advice, instructions, treatment decisions, and other professional health care services performed, and that all diagnoses, treatments, procedures, and other professional health care services will be provided and performed exclusively by or under the supervision of Treating Providers, in their sole discretion, as they deem appropriate.
- LIMITATION OF LIABILITY
YOU UNDERSTAND THAT TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL MEDICAL CERTICATE ONLINE OR ITS OFFICERS, EMPLOYEES, DIRECTORS, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF REVENUES, PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE SERVICES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, STATUTE OR OTHERWISE.

You agree to indemnify, defend and hold harmless Medical Certificate Online, its officers, directors, employees, agents, subsidiaries, affiliates, licensors, and suppliers, harmless from and against any claim, actions, demands, liabilities and settlements, including without limitation reasonable legal and accounting fees (“Claims”), resulting from, or alleged to result from, your violation of these terms and conditions. In addition, you agree to indemnify, defend and hold harmless your Treating Provider(s) from and against any third party Claims resulting from your lack of adherence with the advice or recommendation(s) of such Treating Provider.
- Geographical Restrictions
Medical Certificate Online makes no representation that all products, services and/or material described on the Site, or the Services available through the Site, are appropriate or available for use in locations outside Australia or all states and territories within Australia.
These Terms are governed by the laws of Victoria, Australia.
We may terminate or restrict your access to any of our Online Services at any time without notice. We may modify, suspend or cancel any of the Online Services at any time.
If any of these Terms are held to be invalid, unenforceable or illegal for any reason, the remaining Terms will continue to apply.
