We offer online telehealth services (the “Services”) enabling our members (“Members”) to report their health history and engage healthcare professionals (“Treating Providers”) to obtain medical certificates and other healthcare services where required and appropriate (“Services”).

The content on or accessible through Medical Certificate Online is for informational purposes only and does not constitute medical advice.

These Terms of Use ("Terms") apply to your use of this website ("Website") operated and also applies to any information provided by us on this Website, and any messages sent to or from us electronically either via this site or other related websites and mobile applications ("Online Services").

By using this Website, you agree to the Terms. We may vary these Terms at any time without notice and, if we do, we will provide the updated version on this Website.

If you do not agree to any of the Terms, you must leave this Website and not use our Online Services.

Medical Certificate Online requires that its agreements be made with persons who are qualified to contract. As a patient you must be over the age of eighteen (18) years. In the case of a patient being under the age of eighteen (18) years, a parent or guardian must accept this agreement and must be present at all consultations. We do not provide consultations to children under the age of 12 years of age.

  6. Not Health Advice
Information contained on this Website is of a general nature only, and does not constitute medical advice. None of the Site content (other than information you receive from Treating Providers) should be considered medical advice or an endorsement, representation or warranty that any particular medication or treatment is safe, appropriate, or effective for you.
  7. Lawful Use

  8. Disclaimer of Liability
This Website is provided to you 'as is'. We will endeavor to ensure that content provided on this Website is accurate, complete and kept up-to-date and does not contain errors and omissions, however we do not warrant that this will be the case or that your access to the information will always be uninterrupted, timely or secure. We are not liable for the accuracy and suitability of information, content, services, materials and products included on this Website and on third party websites.

We do not attempt or purport to exclude any liability arising under statute if, and to the extent, that liability cannot be lawfully excluded. However, we exclude to the extent lawfully permitted all liability for any loss or damage of whatever kind (including consequential or incidental damage) and however arising (including due to negligence) that may be suffered, directly or indirectly, in connection with use of this Website or any associated online services. In particular, we exclude all liability for any loss or damage that may result from use of, or reliance upon, any information or material obtained from this Website.

We exclude all implied conditions and warranties except any implied condition or warranty the exclusion of which would cause this clause to be void ("Non-excludable Condition"). Our liability to you for breach of any Non-excludable Condition is limited, at our option, to supplying the relevant services again or paying the cost of re-supplying those services, or alternatively refunding monies paid for the use of the service, except where the services are of a kind ordinarily acquired for personal, domestic or household use or consumption.

  9. Third Party Information and Links to Third Party Websites
We do not take any responsibility for the accuracy or legal compliance of any content supplied to us by any third party, or contained on any third party website linked to the Online Services. Our provision of a link or reference to any third party website (or publication of advertisements on the Online Services) does not constitute any form of endorsement, recommendation or approval from us, nor endorsement, recommendation or approval of the practices of the organisations that operate such websites or provide such advertisements, unless stated otherwise. Any such links are provided for convenience only and may not remain current.
  10. Security
We do not guarantee that files or programs executed and/or downloaded from this Website or provided via the Online Services are free from viruses and other unauthorised or malicious code or corruption that could damage or interfere with data, hardware or software. We are not liable for any such damage or interference you may suffer in connection with use of the Online Services. You assume the risk and liability that may arise from using the Online Services and third party websites. You should establish your own protection against viruses and other causes of damage.

We cannot ensure the security of any information you send to us via the Internet during its transmission. Accordingly, any information you transmit in this manner will be sent at your own risk. We recommend that you do not provide us with confidential information via the Online Services unless you accept the risk that the information may be lost, corrupted, or disclosed to third parties during its transmission.

  11. Intellectual Property and Copyright
We own or licence all copyright and other intellectual property rights in all materials used in the Online Services and all rights are reserved.

You may only use, print or copy parts of this Website or information provided to you via the Online Services for personal (non-commercial) use. 12. Healthcare Services
Medical Certificate Online makes no warranties, whether expressed or implied, as to the content of any medical consultation conducted through our service. You and your doctor are solely responsible for all information and/or communication sent during a consultation or other communication. Your doctor will keep a record of their consultation with you.

Medical Certificate Online does not guarantee that an online Skype consultation is the appropriate course of treatment for your particular health care problem. You agree to contact your own doctor immediately should your condition change or your symptoms worsen. If you require urgent care, you should contact your local emergency services immediately.

The service offered is done so on an "as is" basis and used by the patient solely at his or her own risk. Medical Certificate Online may, among other things withdraw, suspend or discontinue any functionality or feature of its services.

All of the Treating Providers who deliver Services through Medical Certificate Online are independent professionals solely responsible for the services each provides to you.

Medical Certificate Online does not practice medicine or any other licensed profession, and does not interfere with the practice of medicine or any other licensed profession by Treating Providers, each of whom is responsible for his or her services and compliance with the requirements applicable to his or her profession and license.

Neither Medical Certificate Online nor any third parties who promote the Services or provide you with a link to the Service shall be liable for any professional advice you obtain from a Treating Provider via the Services.

  13. Registration
When you register to obtain a product or service on this site, you accept the terms. Your use of any such product or service offered on the site is governed by these terms. Except as provided in the terms, Medical Certificate Online does not warrant that any product descriptions or content contained within the site is accurate, current, reliable, complete, or error-free.

As part of your registration you are required to provide us with certain personally identifiable information. It is your responsibility to update this information so our records are current, complete and accurate.

Medical Certificate Online reserves the right to cancel your registration without notice and at it's sole discretion.

  14. Modification of Medical Certificates or Any other Document issued to you by a Practice or Doctor serving you as part of this Service is Strictly Prohibited
By using this service you agree not to amend, modify, copy, transfer or share any and all documents issued to you as part of this Service with the intention of altering the documents issued to you for your use or by other persons. This includes Medical Certificates, Health Certificates or Statements, Carer or Attendance Certificates, Medical or specialist referrals or any other documents covering the routine medical procedures offered as part of this Service. Any attempt to modify a document will be construed as an intention to commit a fraud and will render the document null and void. In such circumstances, we reserve the right to commence legal action against you. Such actions will also constitute grounds for immediate cancellation of registration and ongoing service and site usage.

Documents issued to you by the practicing doctor or practice from this Service can only be copied or reproduced as to satisfy the person or organisation requesting its contents or the verification of its contents or in fulfilling the request of its intended use.

  15. Network & Data Security
Medical Certificate Online stores data online and as part of the terms you agree to your information being stored online in a secure location and accessed in this way. To facilitate your effective treatment we will supply your treating doctor with the information we have on record about you and provided to us by you.
  16. Recording Policy
Recording consultations by any means is strictly prohibited, unless expressly agreed to by all parties to that consultation. Unauthorised recording of consultations will be considered grounds for immediate cancellation of registration and ongoing service usage.
  17. Booking Fee Refund Policy
Medical Certificate Online charges patients a fee for its services. This fee is charged at the time a booking is made and will be refunded if the doctor cancels the appointment, or if there is a technological failure that prevents an effective consultation between patient and doctor.

Technological failure is assessed and logged by the doctor. The booking fee is generally not refundable if you, as a patient, cancel an appointment or fail to attend.

There is no refund under circumstances where a doctor has provided a medical assessment and determined that the issue of a medical certificate is not appropriate or necessary for whatever reason. The doctor’s judgment will stand as the final decision on the matter and is based on the patient’s symptoms and the doctor’s assessment. Where the doctor deems that issuing a medical certificate may be inappropriate, and not in the best interests of the patient’s health, a medical certificate will not be issued. Medical Certificates will also not be issued if the doctor believes there is a deliberate intent by the patient to commit a fraud in seeking the Medical Certificate. However, the doctor will issue a statement to the patient setting out relevant recommendations for either improving health or a request that the patient seek further medical treatment. This may include seeking a second opinion via a face-to-face appointment with a local doctor.

In some circumstances for example, a physical examination, blood tests, or diagnostic imaging may be required. These elements cannot be delivered via an e-health appointment. If the doctor determines that any or all of these are required, and in the patient’s best interest, the doctor will direct you to make an appointment for an in practice consultation with your local general practitioner.

As part of this service, doctors will not issue medical prescriptions to patients. Doctors will only make recommendations regarding readily available, over the counter remedies available from your local pharmacist or chemist. If you require medical scripts, we recommend that patients visit their local GP. Where a patient is currently being treated by a local GP with prescription medicines, we would recommend that a patient see their local GP or treating doctor for the issue of further prescription based medications.

  18. Intellectual Property Information
The site and the content within the site are the property of Medical Certificate Online or its suppliers and are protected by laws relating to intellectual property, including copyright laws, and international treaty provisions. The compilation, organization and display of the content as well as all software and inventions used on and in connection with the site are the exclusive property of Medical Certificate Online. Medical Certificate Online reserves all rights in the site and its content not specifically granted in any agreements with Medical Certificate Online or in the terms.
  19. Informed Consent
Telehealth is the delivery of health care services using interactive audio and video technology, where the patient and the health care professional are not in the same physical location.

During your telehealth consultation with a Treating Provider, details of your medical or health history and personal health information may be discussed with you through the use of interactive video, audio and other telecommunications technology.

Depending on your medical or health history and/or specific complaint, you may be asked to provide information through biometric devices such as digital thermometers or blood pressure cuffs. You may also be asked for proof of identity with a driver’s license or other legal document. We reserve the right to deny Service provision where the doctor believes proof of identity has not been satisfactorily established.

The telehealth Services you receive from Treating Providers are not intended to replace a primary care physician relationship or be your permanent or primary care medical relationship. You should seek emergency help or follow-up care when recommended by a Treating Provider or when otherwise needed, and continue to consult with your primary care physician and other healthcare professionals as recommended.

We may make arrangements for follow up care either through Medical Certificate Online, a health systems partner or other healthcare providers. If the transmission fails during your telehealth consultation with a Treating Provider, the Treating Provider will make an attempt to reach you again via your Skype address or finally attempt to contact you by telephone.

If you are not contacted by the Treating Provider, then a member of our customer support team will contact you to help you get reconnected. You will have direct access to our customer support services to follow up on following your appointment. We hope that among the benefits of our Services are improved access to healthcare professionals and convenience. However, as with any medical or health service, there are potential risks associated with the use of telehealth. These risks include, but may not be limited to:

    • In rare cases, information transmitted may not be sufficient (e.g. poor resolution of images) to allow for appropriate medical or health care decision making by the Treating Provider;
    • Delays in evaluation or treatment could occur due to failures of the electronic equipment;
    • In rare cases, a lack of access to all of your medical records may result in adverse drug interactions or allergic reactions or other judgment errors;

Although the electronic systems we use will incorporate network and software security protocols to protect the privacy and security of health information, in rare instances, security protocols could fail, causing a breach of privacy of personal health.

By accepting these Terms of Use, you acknowledge that you understand and agree with the following:

    • You understand that you may expect some anticipated benefits from the use of telehealth in your care, but that no results can be guaranteed or assured.
    • You understand that the laws that protect the privacy and security of health information apply to telehealth, and have received and read Medical Certificate Online’s Notice of Privacy Practices, which describes these protections in more detail.
    • You understand that Medical Certificate Online is not covered under Medicare Australia at this time and there is no bulk billing option offered as part of this service at this time.
    • Your Treating Provider may determine that the Services are not appropriate for some or all of your treatment needs, and accordingly may elect not to provide telehealth services to you through the Site or issue a medical certificate to you based on their sole discretion of your stated health condition. These decisions are in your Treating Provider’s sole discretion.
  20. Release and Indemnity
In consideration of Medical Certificate Online (which expression shall be taken to include Medical Certificate Online's servants, agents, officers and directors, successors or assignees) agreeing to permit me use of the site and it’s ancillary services:

    • negligence,
    • breach of contract,
    • breach of statutory duty or
    • otherwise,

suffered as a result of or in connection with my using the site and ancillary services.

  21. Privacy
Medical Certificate Online devotes considerable effort toward ensuring that your personal information is secure. Information regarding our use of health and other personal information is provided in our Site Privacy Policy and health information usage under Notice of Privacy Practices.

As part of providing you the Services, we may need to provide you with certain communications, such as appointment reminders, service announcements, relevant marketing messages, new complimentary service announcements and administrative messages. These communications are considered part of the Services and your Account. Secure electronic messaging is always preferred to insecure email, but under certain circumstances, insecure email communication containing personal health information may take place between you and Medical Certificate Online.

You are responsible for maintaining the confidentiality of your Account password and for all activities that occur under your Account. Medical Certificate Online reserves the right to take any and all action, as it deems necessary or reasonable, regarding the security of the Site and your Account Information. In no event and under no circumstances shall Medical Certificate Online be held liable to you for any liabilities or damages resulting from or arising out of your use of the Site, your use of the Account Information or your release of the Account Information to a third party. You may not use anyone else’s account at any time. We also reserve the right to request proof of identity at the commencement of each appointment. If we are not satisfied by this proof we may deny offering services to you through the Site.

  24. Use of the Services by Children
The Services are available for use by children, but the Member for all patients between the ages of 12 and 18 must be the patient’s parent or legal guardian. If you register as the parent or legal guardian on behalf of a minor, you will be fully responsible for complying with these Terms of Use. In the case of a patient being under the age of eighteen (18) years, a parent or guardian must accept this agreement and must be present at all consultations. We do not provide consultations to children under the age of 12 years of age.
  25. Access Rights
We hereby grant to you a limited, non-exclusive, nontransferable right to access the Site and use the Services solely for your personal non-commercial use and only as permitted under these Terms of Use and any separate agreements you may have entered into with us (“Access Rights”). We reserve the right, in our sole discretion, to deny or suspend use of the Site or Services to anyone for any reason. In addition, you agree to refrain from abusive language when communicating with Treating Providers through the Site and to refrain from contacting Treating Providers for telehealth services outside of the Site or following completion of your agreed appointment. Medical Certificate Online is not responsible for any interactions with Treating Providers that are not conducted through the Site. We strongly recommend that you do not use the Services on public computers. We also recommend that you do not store your Account password through your web browser or other software.
  26. Fees & Purchase Terms
You agree to pay all fees or charges to your Account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. By providing Medical Certificate Online with your credit card number or PayPal account and associated payment information, you agree that Medical Certificate Online is authorized to immediately invoice your account for all fees and charges due and payable to Medical Certificate Online hereunder and that no additional notice or consent is required.
